RESUMO

Introdução: Uma das funções da Medicina Legal é realizar exames de corpo de delito em sobreviventes de acidentes de trânsito para fornecer  elementos probatórios para a investigação criminal do ocorrido e também para finalidades securitárias (pagamento do seguro DPVAT). Este trabalho tem o objetivo de avaliar  a relação entre uma lesão no lobo frontal (LF) com mudanças comportamentais,  bem como destacar o papel destas na invalidez segundo a tabela do DPVAT.

Metodologia: Relato de caso atendido no contexto médico legal, utilizando o laudo pericial, o boletim de ocorrência relacionado ao evento, a análise de relatórios médicos e exames complementares realizados. Tanto a periciada como sua responsável legal autorizaram a realização deste trabalho.

Descrição do caso: Tratava-se de periciada que sofreu com 16 anos um traumatismo crânio-encefálico (TCE) grave em acidente automobilístico. Na admissão hospitalar foi diagnosticado afundamento frontal aberto, contusão no LF direito, hemorragia subaracnóidea traumática e lesão axonal difusa. Após alta hospitalar, ao longo do tempo, apresentou mudanças comportamentais, como episódios de agressividade inexplicada e comportamentos impróprios para o contexto social. Foi submetida a exame médico legal após 16 meses do trauma, então com 18 anos de idade e diagnóstico de síndrome pós-traumática / síndrome do LF. O diagnóstico ocorreu pela higidez pré-trauma, histórico de TCE grave, presença de lesão cerebral permanente, ausência de alteração no nível de consciência e memória, insônia e fadiga pós-trauma, bem como alterações comportamentais que persistiram após um ano do trauma. A última tomografia de crânio indicou área de formação cística no lobo frontal direito. O córtex pré-frontal, localizado nos lobos frontais, é essencial para funções cognitivas complexas como a tomada de decisões, o juízo ético e moral, dentre outras. Lesões extensas desta área podem ocasionar importantes alterações comportamentais, como observado na periciada, que se enquadram na definição médico legal de enfermidade incurável e de invalidez total e permanente pelos parâmetros do seguro DPVAT.

Conclusão: A síndrome do LF é uma complicação rara, mas potencialmente grave de um TCE grave, apresentando importantes repercussões sociais e médico-legais.
