DESVALORIZAÇÃO MONETÁRIA DA INDENIZAÇÃO PAGA POR MORTE EM VITIMAS DE ACIDENTE AUTOMOTORES TERRESTRE DESDE A PUBLICAÇÃO DA LEI 11.945 DE 2009

ABSTRACT
The present paper presents the depreciation of the financial indemnity paid for fatal victims of motor vehicle accidents since the Law 11.495 was enacted until today. Depreciation was calculated according to official inflation rates as measured by the IPC-A index and to the readjustments of the DPVAT insurance premiums paid for motorcicles during the same period.
OBJECTIVES: To calculate the percentages by which financial indemnity for fatal motor vehicle accidents should be readjusted based on inflation and on motorcycle premium increases in the same period.
METHODS: Indemnity values were recalculated year after year from 2009, when Law 11.495 was enacted to 2016, using IPC-A index and premium readjustments for the same period, using an IBM calculator.
RESULTS: Using simple mathematical calculations, the depreciation of financial indemnity values paid for deaths by motor vehicle accident based on inflation is of 65.16%, and based on motorcycle premium readjustments is of 12.73%.
CONCLUSIONS: Indemnity values ought to be readjusted, not in order to be raised but to reset devaluation due to monetary depreciation.
