The psychiatric expertise in labor claims constitutes an extra challenge for the medical expert, since it presents a high degree of subjectivity. The present study proposes a methodology for sorting and systematizing expert elements, allowing for greater clarity in the arguments and basis of the conclusions.
It consists of 4-steps questions to be answered by the expert based on the information collected in the process and/or determined from the expert interview:
1. What is the medical diagnosis?
2. Is there a temporal compatibility between illness and work?
3. Can the diagnosed pathology be triggered or aggravated by stressful situations in the work environment, according to the medical literature?
4. Is there documentary evidence of significant stressful situations in the workplace?
At the end, a flowchart is proposed to be followed by the labor medical expert involving allegation of psychiatric disorder.
