ABSTRACT
Introduction: This investigation aims to examine the implications of civil liability attributed to plastic surgeons in the state of Ceará, with an emphasis on quantifying and qualifying the main surgical procedures involved in incidents classified as ‘medical error’. Methlodology: Quantitative methodological approach of a descriptive and analytical nature, using secondary procedural data extracted from the selection repository of the Court of Justice of the State of Ceará (TJCE). Judicial decisions in the appeal court, pertinent to plastic surgical practice, in the period between 2000 and 2022, were demonstrated to identify incidences and profiles of civil liability attributed to professionals in the medical field in question. Theoretical framework: The increasing incidence of medical malpractice litigation in Brazil is notable, doubling from 17,731 cases in 2015 to 36,619 in 2020. This requires careful assessment from medical, social and economic angles to understand the complexity and factors associated with these arguments. Conclusion: Alleged medical error lawsuits by plastic surgeons in Ceará between 2000-2022 represent around 5.14% of the total lawsuits on medical civil liability cases, in relation to all specialties. The procedures that were most associated with medical civil liability actions were abdominoplasty and mammoplasty. In approximately 83.4%, documentary evidence generated by medical expertise was used to assess the legal dispute. In 75% of visible cases, sufficient elements were not found to prove medical culpability.
