Obesity as a Cause of Disability and Incapacity: A Forensic Medical Perspective in the Brazilian Population

Abstract
INTRODUCTION: The rising prevalence of obesity in Brazil represents a major public health issue, increasing from 11.8% in 2006 to 20.3% in 2019, with projections reaching 29.6% by 2030. This condition has substantial economic impact, with estimated direct healthcare costs of approximately 1.8 billion USD between 2021 and 2030. This article discusses the medico-legal implications of obesity, focusing on its assessment for granting work disability benefits and classification as a disability under Law No. 8.742/93. METHODOLOGY: Through a narrative review of scientific literature and relevant regulations, the complex pathophysiology of obesity and its multifactorial impact on functional capacity are analyzed. This impact transcends mere excess weight, involving inflammatory, metabolic, biomechanical, and psychosocial aspects, often associated with comorbidities. DISCUSSION: It is argued that expert medical evaluation must be individualized, evidence-based, and utilize the domains of the International Classification of Functioning, Disability and Health (ICF), as proposed by the Modified Brazilian Functionality Index (IF-BR), overcoming guidelines that may underestimate treatment complexity and the time required for recovery or functional adaptation. CONCLUSION: The conclusion emphasizes the need for a rigorous and "sensitized" medico-legal evaluation that considers obesity as a potential cause of temporary or permanent incapacity and/or long-term impairment, ensuring the correct application of social security and social rights.
