ABSTRACT

INTRODUCTION: Some judges and courts understand that the expert evaluation for assessing bodily injury can be carried out by health professionals, not necessarily doctors. The object of the present study is to demonstrate that knowledge of medicine is a necessary condition for the correct assessment of bodily injury and its sequelae. MATERIAL AND METHOD: the methodological basis was the research of federal legislation and state laws that regulate the expertise and knowledge necessary for the assessment of bodily injury. RESULTS: The assessment of bodily damage is only possible with mastery of knowledge of diseases and their manifestations, from pre-existing pathologies, nature of the injury with typification of the instrument or means that produced it, applied therapies, definition and quantification of sequelae, possibility of recovery with complementary procedures, therefore, of complete medical semiology. The procedural, criminal and social security rites already establish that the expert evaluation

3 to assess injury, causal link and disability is the exclusive responsibility of the public servant doctor (official inspector). The Civil Procedure Code and labor legislation do not specifically define the expertise for assessing bodily injury. DISCUSSION AND CONCLUSION: The assessment of bodily harm within the scope of Civil and Labor Justice demands the same level of technical and scientific knowledge as the expertise carried out within the scope of Criminal and Social Security Justice, therefore, it requires training in Medicine, preferably with a specialization in Legal Medicine and Medical Expertise.
