THE CONTRIBUTION OF SPECIALISTS IN FORENSIC MEDICINE AND MEDICAL EXPERTISE IN HEALTH SERVICE

RESUMEN
Introducción: Con la creciente demanda de pericias médicas judiciales con motivo de los litigios que incluyen la invocación de Daños Asociados a los Cuidados de Salud y el sabido desconocimiento de cuestiones providenciales por parte de los equipos de salud, este trabajo tiene como objetivo discutir la utilidad del especialista en Medicina Legal y Pericias Médicas en los servicios de salud como consultor en estas cuestiones. Material y Método: revisión literaria no sistematizada acerca de los temas “error médico”, pericia médica providencial, derecho médico y medicina legal y pericias médicas. Resultados: no se han encontrado trabajos discutiendo acerca de la utilidad del especialista en cuestión actuando en el servicio de salud, habiendo encontrado trabajos relacionados al tema y algunas repercusiones de litigio involucrando a la salud. Conclusión: el especialista en Medicina Legal y Pericias Médicas, por ser el eslabón entre los conocimientos médicos y del derecho, posee competencia técnica para actuar de forma interdisciplinaria en el servicio de salud en lo que concierne a cuestiones éticas y jurídicas en este servicio.

ABSTRACT
Introduction: With the growing demand for judicial medical expertise due to litigations involving allegations of damages associated with health care and the known ignorance of social security issues by health teams, this paper aims to discuss the usefulness of the specialist in Legal Medicine and Medical Expertise in health services as a consultant on these issues. Material and Method: non-systematic literary review on the themes of “medical error”, social security medical expertise, medical law and legal medicine and medical expertise. Results: no studies were found discussing the usefulness of the specialist in question working in health services, having found studies related to the theme and some repercussions of litigation involving health. Conclusion: the specialist in Forensic Medicine and Medical Expertise for being the link between medical knowledge and the law has technical competence to act in an interdisciplinary way in health services with regard to ethical and legal issues in these services.
