THE CHARACTERIZATION OF PARTIAL WORK DISABILITY INVOLVING A PUBLIC EMPLOYEE.

Abstract
INTRODUCTION: The assessment of work disability in public employees requires an integrated medical-forensic evaluation, encompassing diagnosis, causal link, analysis of job duties, and functional implications. OBJECTIVE: To analyze the medical-forensic report to verify the causal link and work capacity of a public employee. METHOD: A case study based on a judicial expert report, physical examination, case documentation, the literature, and technical standards. RESULTS AND DISCUSSION: Permanent monocular blindness resulting from a non-work-related accident was identified, along with the absence of a causal link to work and a partial, permanent, and single-occupation work disability for diving and water rescue activities, while maintaining fitness for compatible activities; the case highlights a conflict between the employer and the INSS regarding the rehabilitation of a public employee covered by the CLT. The integration of document analysis, task descriptions, clinical examination, and specialized literature made it possible to distinguish between partial and total disability and to substantiate functional compatibility without a change in job duties. CONCLUSION: Occupational medical evaluation is an essential tool for decisions regarding work capacity, functional rehabilitation, and the safety of workers and third parties.
